Terms of Service: Pathao PointsLast updated: September 24, 2019
PLEASE ENSURE THAT YOU READ AND UNDERSTAND THE FOLLOWING TERMS AND CONDITIONS FOR PATHAO POINTS IN ORDER TO BE ENTITLED AND AVAIL VARIOUS OFFERS, DISCOUNTS, PRIVILEGES (LOYALTY BENEFITS) FOR USING PATHAO APPLICATION.
1.1. In order to participate as a Program Member (defined below) in the Program, you must have an active account in Pathao Application and therefore must comply with the requirements of such account as contained in the general terms and conditions.
1.2. You cannot share memberships or have multiple memberships and also cannot transfer, merge or otherwise delegate any point you may earn.
1.3 During the initial phases of the Program, you are eligible for the Program with a base level i.e BRONZE.
2. Earning Points
2.1. For a successful transaction (Cash/Digital Payment), you will earn ’01’ Point for spending ‘10’ BDT when using Pathao services (Ride/Food).
2.2. Points are earned at the time an eligible Pathao service (Ride/Food/Parcel) transaction is processed by Pathao against your payment method for the successful transaction.
2.3. Points you have earned cannot be converted into cash value.
2.4. You will be able to use your earned points for redeeming in exchange of value for making/adjusting payments against Pathao services and purchasing deals offered by Pathao from time to time.
2.5. The amount you spent may earn a different number of Points, depending on the locality, type of transaction or order meaning, Earned Point against spending amount in a city for a specific service of Pathao.
2.6. Redeemable Points and Level Points are earned concurrently, however, there may be some actions or other types of transactions that only accrue one type of Point and will be subject to any additional terms set forth in such promotional offer.
3. Program Benefits
3.1. Benefits for Program Members are privileges granted to you on the basis of your Membership Level . Therefore, you may get a certain percentage/amount of discount (“Program Benefits”) provided by third-party partners for on-spot spending. But for such spending you will not earn any points.
3.2. Program Benefits are granted at the discretion of Pathao and Third-Party Partners.
4. Redemption of Earned Points in Purchasing Deals
4.1. The Earned Points can be redeemed by using the same for purchasing any ‘deal’ offered by Pathao from time to time. Pathao may offer Chosen Deals in the Pathao app in exchange for a certain number of earned points. There will be a limit for purchasing deals in a given day and the same will change from time to time at the sole discretion of Pathao.
4.2. According to the purchased deal, you will enjoy that deal’s offer, just from the next immediate service, based on current flow.
4.3. Unused Earned Point will expire at the end of the Period (defined below) after which it was earned.
4.4. There is a flat limit on daily purchase deal . meaning you cannot make more than a certain number of deals in a day. While purchasing any deal, if your daily limit exceeds, you will be shown the message – your daily limit exceeds.
4.6 For fare adjustment case, the initially given points will remain the same, no adjustment/deduction on points.
4.7. The Chosen Deals available and the number of Points required for redemption of a Chosen Deals will be displayed in the app and may vary at Pathao’s sole discretion.
4.8 As a Program Member you cannot purchase any deal from upper level, but can purchase any deal from lower level
4.9 Chosen Deals are subject to change, substitution, or termination by Pathao in its sole discretion at any time without any notice. See specific Chosen Reward offers for any additional terms and conditions.
4.10 Redemption of Points against Deals Offered by Pathao is subject to additional terms and conditions, such as restrictions on use. Once Points are converted to deals, they cannot be returned to your Program Account. Moreover, you will not earn any points for making any deals with the earned points.
5. Program Membership Levels and Window
5.1. Your level as a User/Program member will be determined automatically upon you reached a threshold of points as mentioned herein below. You, as a participant in the Program is “Program Members”. The Program offers 04 (Four) types of level depending on 04 (Four) tiers (range) of points as per the following table:

5.2. You may advance to the next Membership Level by accruing said minimum number of Level Points as mentioned above, during a six-month period (the “Earnings Window”).
5.2. The Earnings Window for you begins on the day you become a Program Member. Once a new Membership Level is unlocked by earning required points, you move to the next level.
6. Upgradation to Next Level:
You, as a User will be upgraded to the next level whenever achieve the higher level’s Earned Point instantly.
7. Level Down:
You, as a User will be downgraded to the down level on 30th June or 31st Dec in a year, automatically, if you do not earn the required Earned Point of your current level on that H (of the year). But if you do not earn necessary point for Bronze, you will stay on bronze as there is no down level less than bronze).
8. Validity and Expiration of Point
8.1. Reward period under this program is divided in 02 session each having 06 months period.
8.2 Points will expire and reset to new number and level upon deduction of expired points on the basis of total valid total points at the end of every six-month Earnings Window.
8.3 Points earned during January-June period of a year will expire on 31st December of the year.
8.4 Points earned during July-December period will expire on 30th December of the year.
8.5 Unused points will expire at the end of the Reward Period 30th June and 31st December of the year but Level will remain unchanged.
8.6. Level Points are non-transferrable and expire at the end of last six-month Earnings Window (defined below).
9. Fraud & Revocation of Points
9.1. If a specific transaction is detected as fraud then that particular transaction will be void and given points will be deducted from the user’s pocket.
9.2. Points may be revoked if a ride or order, for which Points were earned, is refunded.
9.4. In case if there are no points available then no action will be taken.
10. Account Termination
10.1. Participation in the Program is a privilege granted to Program Members, and as such can be suspended, revoked, or terminated at any time by us for any reason.
10.2. If your Program membership is terminated, all Points associated with your Program membership and any Program Benefits will be forfeited immediately upon termination.
10.3 If your Program membership is terminated due to fraudulent activity or noncompliance with these Program Terms, in addition to forfeiting all Points and Program Benefits associated with your Program membership immediately, you cannot participate in or rejoin the Program.
11. Program Changes and Termination
11.1. Pathao reserve the right to change or terminate the Program, or any part thereof, at any time without notice and without further obligations to Program Members, including, but not limited to modifications which: a) govern how Points are earned on and after the date of change; or b) change the value of rewards.
11.2 No Points will be earned or redeemed after the effective date of termination. Any and all changes and/or amendments to these Program Terms will become binding upon all members immediately.
12. Transfer of Rights
Pathao’s rights and obligations under the Program may be assigned or transferred by Pathao to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.
13. Interpretation of Program Terms
All interpretations of these Program Terms will be at Pathao’s sole discretion and Pathao’s decisions will be final.
The Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions or errors of the Program or its features. Pathao is not responsible for unauthorized use of Points. If your Pathao account is closed, you will lose all Points. Pathao may from time to time request information from you to confirm your identity before it will allow the use of your Points. Pathao may delay your access to the Points until you comply with this information request. The Program and all the information accessible through it are provided for information purposes only on an “as is” and “as available” basis. We, our information providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. All benefits and rewards made available under the Program, if any, are provided by Pathao and do not modify the contractual relationships among or between Program Members, the individuals and entities that use Pathao’s technology to offer goods or services, and Pathao or any affiliates. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, the implied warranty of merchantability and fitness for a particular purpose.
